These Terms of Service (“Terms”) govern your access to and use of Fibonomy, including the Fibonomy website, applications, connected services, and related features (collectively, the “Service”).

By accessing or using Fibonomy, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. About Fibonomy

Fibonomy is currently operated as an independent, unincorporated project.

Fibonomy provides tools designed to help users understand trading positions, account state, trading history, position changes, and related trading data.

Fibonomy is not a cryptocurrency exchange, broker, financial adviser, investment adviser, asset manager, or trading signal provider.

2. Eligibility

You must be legally capable of entering into a binding agreement in the jurisdiction where you live.

You must not use Fibonomy if your use of the Service would violate applicable law, regulation, sanctions, exchange rules, or contractual obligations.

You are responsible for ensuring that your use of Fibonomy is lawful in your jurisdiction.

3. What Fibonomy Does

Fibonomy may help you:

  • connect supported exchange accounts using permitted credentials,
  • retrieve and organize trading data,
  • reconstruct trading positions and position changes,
  • review open and closed positions,
  • view account-level information,
  • calculate or estimate trading-related metrics,
  • identify changes or patterns in available data,
  • and better understand the relationship between positions, account state, and capital exposure.

Features may change over time.

Not every feature is available for every exchange, contract type, account mode, jurisdiction, or user.

4. Read-Only Exchange Access

Where exchange connections are supported, Fibonomy is designed to use read-only permissions for retrieving the data needed to provide the Service.

Fibonomy does not require permission to:

  • execute trades,
  • place orders,
  • withdraw funds,
  • transfer assets,
  • or otherwise control funds in your exchange account

for the current read-only product functionality.

You are responsible for configuring exchange API credentials correctly and restricting permissions to those actually required.

You must never provide Fibonomy with withdrawal permissions, transfer permissions, seed phrases, private keys, account passwords, or other credentials that Fibonomy does not request.

5. No Trade Execution

Unless Fibonomy explicitly introduces a separate feature in the future and you expressly enable it under separate applicable terms, Fibonomy does not execute trades on your behalf.

The current Service does not:

  • open positions,
  • close positions,
  • increase or reduce positions,
  • move stop-loss orders,
  • place take-profit orders,
  • transfer funds,
  • or automatically trade for you.

Any trading action remains your responsibility and must be performed through your exchange or another service you choose to use.

6. No Financial, Investment, or Trading Advice

Fibonomy provides information, calculations, reconstructions, and analytical tools.

It does not provide personalized financial, investment, legal, tax, or trading advice.

Nothing available through Fibonomy should be interpreted as:

  • a recommendation to buy or sell an asset,
  • a recommendation to enter or exit a position,
  • a trading signal,
  • a prediction of future market performance,
  • a guarantee of profit,
  • or a guarantee that a loss will be avoided.

You remain solely responsible for your trading and investment decisions.

7. Trading Risk

Trading cryptocurrencies, derivatives, perpetual futures, leveraged products, and other financial instruments involves substantial risk.

Leverage can increase losses.

Positions may be liquidated.

Stop-loss orders may not execute at the expected price or may not fully prevent losses.

Fees, funding payments, slippage, market gaps, exchange rules, margin requirements, liquidity, outages, and market volatility can materially affect trading outcomes.

You should not rely on Fibonomy as your sole source for determining whether a position is safe or appropriate.

8. Data, Calculations, and Reconstructions

Fibonomy depends on data obtained from exchanges, APIs, account records, and other technical sources.

That data may be:

  • incomplete,
  • delayed,
  • unavailable,
  • inconsistent,
  • revised,
  • incorrectly reported by a third party,
  • or subject to historical retention limits.

Fibonomy may also derive calculations or reconstructions from available data.

A reconstruction represents Fibonomy’s attempt to organize available information into a clearer representation of what occurred. It does not guarantee that every historical event can be recovered or reconstructed perfectly.

Where data is incomplete or uncertain, Fibonomy may indicate that a result is unavailable, estimated, incomplete, or based on a fallback calculation.

9. Exchange-Specific Differences

Different exchanges may calculate or expose:

  • margin,
  • liquidation price,
  • maintenance margin,
  • funding,
  • realized P&L,
  • unrealized P&L,
  • average entry price,
  • fees,
  • collateral,
  • and account equity

in different ways.

The same exchange may also use different rules depending on account mode, contract type, margin mode, position mode, risk tier, or other settings.

Fibonomy may therefore produce different results for different exchange environments.

You should consult the current documentation of your exchange where exact exchange mechanics matter.

10. Third-Party Services

Fibonomy may depend on or interact with third-party services, including cryptocurrency exchanges, infrastructure providers, analytics services, authentication services, and payment providers.

Fibonomy does not control those third parties.

Their availability, accuracy, security, rules, APIs, fees, or business operations may change without notice.

Your use of a third-party service remains subject to that provider’s own terms and policies.

Fibonomy is not responsible for losses caused solely by the independent acts, failures, outages, or rule changes of third-party services, except where liability cannot lawfully be excluded.

11. Accounts and Security

You are responsible for maintaining the security of your Fibonomy account.

You must provide accurate information where required and take reasonable steps to protect:

  • your login credentials,
  • authentication methods,
  • exchange API credentials,
  • connected accounts,
  • and devices used to access Fibonomy.

You must notify Fibonomy promptly if you reasonably believe your Fibonomy account or a connected credential has been compromised.

You must not intentionally provide credentials with permissions greater than those requested by Fibonomy.

12. Subscription and Pricing

Fibonomy currently offers paid access at:

USD $29 per month

unless a different price is clearly displayed to you before purchase.

The current subscription model is manual.

Your monthly subscription does not automatically renew unless Fibonomy clearly informs you otherwise before purchase and you expressly agree to recurring billing.

At the end of a paid access period, you may need to purchase another subscription period to continue using paid features.

Prices may change in the future.

A pricing change will not retroactively alter a period you have already paid for.

Any applicable taxes, currency conversion fees, payment processing charges, or bank charges may be handled separately depending on your location and payment provider.

13. Free Trial

Fibonomy may provide eligible users with a free trial.

The current trial period is:

Eligibility and trial availability may vary.

Unless clearly disclosed otherwise at the time the trial begins, the trial does not automatically convert into a paid subscription.

At the end of the trial, you may need to manually purchase a subscription to continue accessing paid features.

Fibonomy may limit repeated trials or trial abuse.

14. Refunds

Fibonomy provides a refund process for eligible purchases.

You may request a refund within:

Please include enough information for Fibonomy to identify the relevant purchase.

Refund eligibility may depend on the circumstances of the request, the amount of Service already used, payment-provider limitations, fraud or abuse indicators, and any mandatory consumer rights that apply.

Nothing in this section limits any refund, remedy, consumer guarantee, or other right that cannot lawfully be excluded.

15. Australian Consumer Law

Where the Australian Consumer Law applies, you may have statutory rights and consumer guarantees that cannot be excluded, restricted, or modified by these Terms.

Nothing in these Terms is intended to exclude, restrict, or modify any guarantee, right, remedy, condition, or liability where doing so would be unlawful.

If there is an inconsistency between these Terms and a mandatory legal right that applies to you, the mandatory legal right prevails to the extent of that inconsistency.

16. Acceptable Use

You must not use Fibonomy to:

  • violate applicable law,
  • access another person’s account without authorization,
  • interfere with the Service or its infrastructure,
  • attempt to bypass access controls,
  • probe or exploit security vulnerabilities without authorization,
  • distribute malware,
  • scrape the Service in a manner that materially interferes with its operation,
  • reverse engineer protected portions of the Service except where applicable law expressly permits it,
  • impersonate another person,
  • abuse trials, refunds, promotions, or payment systems,
  • or use Fibonomy in a way designed to harm Fibonomy, other users, exchanges, or third parties.

Reasonable use of public content for ordinary browsing, linking, and search indexing is not prohibited by this section.

17. Intellectual Property

Fibonomy and its original software, product design, interfaces, branding, documentation, visualizations, written material, and other original content are protected by applicable intellectual-property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms.

They do not transfer ownership of Fibonomy intellectual property to you.

You retain ownership of data that belongs to you.

Your use of Fibonomy does not give Fibonomy ownership of your underlying exchange account or trading assets.

18. Feedback

If you voluntarily provide product feedback, suggestions, ideas, or recommendations, Fibonomy may use that feedback to improve the Service without an obligation to compensate you.

This does not transfer ownership of your private trading data or personal information.

19. Service Availability and Changes

Fibonomy may add, modify, suspend, or discontinue features.

The Service may occasionally be unavailable because of:

  • maintenance,
  • technical failures,
  • exchange outages,
  • API failures,
  • infrastructure incidents,
  • security events,
  • or circumstances outside Fibonomy’s reasonable control.

Fibonomy does not guarantee uninterrupted or error-free availability.

Where reasonably practicable, material changes affecting paid users should be communicated appropriately.

20. Suspension and Termination

Fibonomy may suspend or terminate access where reasonably necessary because of:

  • a material breach of these Terms,
  • unlawful activity,
  • security risk,
  • fraud,
  • abuse,
  • non-payment,
  • or conduct that materially threatens the Service or other users.

Where appropriate and reasonably practicable, Fibonomy may provide notice or an opportunity to correct the issue.

You may stop using Fibonomy at any time.

Termination does not remove rights or obligations that arose before termination.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Fibonomy is not liable for indirect, incidental, special, consequential, or purely economic losses arising from your trading decisions, market movements, exchange failures, or reliance on third-party data.

Fibonomy does not accept responsibility for trading losses merely because information from the Service was viewed before a trading decision.

However, nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Where liability can lawfully be limited but not excluded, Fibonomy’s liability will be limited only to the extent permitted by applicable law.

22. No Guarantee of Trading Outcomes

Fibonomy does not guarantee that using the Service will:

  • improve trading performance,
  • prevent liquidation,
  • reduce losses,
  • increase profitability,
  • identify every risk,
  • reconstruct every position perfectly,
  • or detect every trading pattern.

Visibility and analysis do not eliminate trading risk.

23. Privacy

Your use of Fibonomy is also subject to the Fibonomy Privacy Policy.

The Privacy Policy explains how Fibonomy collects, uses, stores, and handles personal information and connected account data.

24. Changes to These Terms

Fibonomy may update these Terms when the Service, business model, legal requirements, or product functionality changes.

The updated version will display a revised “Last Updated” date.

Where a change materially affects existing paid users, Fibonomy will take reasonable steps to provide appropriate notice.

Continuing to use the Service after updated Terms take effect means you agree to the updated Terms, except where applicable law requires a different form of consent.

25. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.

Subject to any mandatory rights or jurisdictional rules that apply to you, disputes relating to these Terms or the Service will be subject to the courts of New South Wales, Australia.

Nothing in this section removes any consumer protection or other mandatory legal right that cannot lawfully be excluded.
